Real Estate Guidance for Personal Representatives, Families and Estate Professionals

Selling a home after someone dies is rarely a routine real estate transaction.

There may be questions about title, who has authority to make decisions, personal property, repairs, clean-out, creditors, timing, family communication and what the property is realistically worth.

My role is to manage the real estate side of that process.

I help personal representatives and families evaluate the property, understand their selling options, prepare the home appropriately, coordinate the professionals needed for the transaction, market the property, negotiate offers and move the sale through closing.

I do not provide legal or tax advice. When a question belongs with an estate attorney, tax professional or title professional, I want the right professional answering it.

The goal is not to make probate sound simple.

It is to make the real estate portion organized, understandable and manageable.

Does the Property Actually Need Probate?

Not every home owned by someone who dies necessarily passes through probate.

How the property was titled matters.

For example, real estate may be treated differently when it was:

  • Owned solely by the person who died

  • Owned in joint tenancy with right of survivorship

  • Held in a trust

  • Owned with another person as tenants in common

  • Subject to another estate-planning arrangement

That determination is a legal and title question.

Before assuming a house must be sold through probate, I encourage the family or personal representative to confirm the ownership and estate structure with the appropriate attorney and title professional.

Once we understand who has authority over the real estate, I can help build the selling strategy.

Who Has Authority to Sell Estate Real Estate?

In a Minnesota probate proceeding, the court appoints a personal representative to administer the estate.

You may also hear the older terms “executor” or “administrator.”

Being named in a will does not, by itself, necessarily mean someone has already been legally appointed to act for the estate.

Before moving too far into a sale, I want to know:

  • Has a personal representative been appointed?

  • Is there more than one personal representative?

  • Is there an estate attorney?

  • Are there restrictions affecting the property?

  • Is the home actually a probate asset?

  • Who will have authority to sign the real estate documents?

  • Are there probate timing requirements that need to be considered?

I coordinate with the estate's attorney and title professionals on those questions rather than guessing.

Start With the Property — Not the Clean-Out

You do not need to empty the house before calling me.

In fact, I would often rather see the property before a family spends significant time or money preparing it.

Our first property review can help answer:

  • What condition is the home really in?

  • What is likely to matter to buyers?

  • What repairs are worth considering?

  • What should probably be left alone?

  • Is a full clean-out necessary?

  • Could some personal property remain until later?

  • Would an estate sale make sense?

  • Is selling as-is a reasonable option?

  • Would selective improvements produce a worthwhile return?

  • What could the property realistically sell for in its current condition?

Families sometimes spend thousands of dollars fixing things that would not materially change the sale.

My job is to help separate necessary work from optional work before money is spent.

What Is the Estate Property Worth?

A probate or estate-owned property still has to compete in the same real estate market as every other home.

I analyze:

  • Recent comparable sales

  • Current active competition

  • Pending sales

  • Property condition

  • Updates and deferred maintenance

  • Lot and location

  • Buyer demand

  • Financing limitations caused by condition

  • Current market conditions

  • Likely buyer pool

  • The cost and potential return of improvements

I can prepare a real estate market analysis to help determine a selling strategy.

If the estate, attorney, accountant or tax professional requires a formal appraisal or date-of-death valuation, I can help coordinate with a licensed appraiser, but that is different from the market analysis I prepare for a sale.

Repair It, Clean It Out or Sell As-Is?

There is no single correct answer.

Depending on the property and the estate's priorities, the strategy may be:

Prepare the Home for the Traditional Market

This may make sense when selective repairs, cleaning, staging or improvements are likely to meaningfully improve buyer demand or the estate's net proceeds.

Sell Through the MLS As-Is

An as-is sale can still receive broad market exposure.

The property can be professionally marketed while making it clear that the estate does not intend to complete repairs before closing.

Compare Cash or Investor Offers

Sometimes speed, certainty or property condition makes a direct offer worth considering.

That does not mean the first cash offer is automatically the right choice.

I can help compare the likely net proceeds, timing, contingencies and risk of different options so the personal representative can make an informed decision.

Clean-Outs, Estate Sales and Property Preparation

Estate properties often involve far more than putting a sign in the yard.

Depending on what the home needs, I can help coordinate resources for:

  • Estate sales

  • Personal-property removal

  • Donation

  • Junk removal

  • Cleaning

  • Yard work

  • Handyman projects

  • Repairs

  • Painting

  • Movers

  • Contractors

  • Inspections

  • Appraisals

  • Property photography

  • Home warranties when appropriate

The personal representative remains the decision-maker.

My job is to help organize the real estate-related work and keep the preparation aligned with the selling strategy.

One Real Estate Advisor — Supported by the Right Team

I am a solo real estate advisor.

When you hire me, I am the person responsible for the real estate strategy, pricing guidance, marketing, negotiations and transaction oversight.

I am also supported by a professional team around the transaction.

Depending on the estate and property, that may include:

  • My office staff

  • The estate's attorney

  • Title professionals

  • Inspectors

  • Appraisers

  • Mortgage professionals

  • Clean-out and estate-sale professionals

  • Contractors and repair professionals

  • Movers

  • Cleaners

  • Other specialists needed for the property

I do not try to become the lawyer, accountant, contractor, title examiner and estate-sale company.

I coordinate with the appropriate professionals so each person stays in the role they are qualified to handle.

I Like to Involve Title Early

Title issues are easier to address early than days before closing.

For an estate property, opening the title work early can help identify documents or issues that may need attention before a buyer is waiting for a closing date.

Depending on the property, the title professional may need to review matters involving:

  • Current ownership

  • Probate documents

  • The personal representative's authority

  • Existing mortgages

  • Recorded liens

  • Property taxes

  • Judgments

  • Association requirements

  • Prior deeds

  • Other recorded interests affecting title

The title company and estate attorney determine the legal requirements.

My job is to make sure the real estate transaction is coordinated with that work.

What If Several Family Members Are Involved?

Estate sales can involve several people who care deeply about the property while only one or a few people have legal authority to make decisions.

That can create confusion.

At the beginning, I want to establish:

  • Who is my authorized decision-maker?

  • Who should receive updates?

  • Who should participate in property-preparation decisions?

  • Who has signing authority?

  • How should communication be handled?

I work through the legally authorized decision-maker while respecting any communication plan the personal representative and family establish.

I am there to provide real estate guidance — not to decide family disagreements or give legal advice.

What If the Personal Representative Lives Out of State?

That is manageable.

A personal representative does not necessarily need to be physically present for every step of the real estate process.

Depending on the property and estate, I can help coordinate:

  • Property access

  • Vendor appointments

  • Clean-out

  • Repairs

  • Photography

  • Showings

  • Inspections

  • Appraisal access

  • Title communication

  • Electronic documents

  • Closing logistics

Having a local real estate advisor who can keep an eye on the property and coordinate the moving pieces can be especially valuable when the personal representative lives elsewhere.

How I Market Probate and Estate Property

The fact that a property is connected to an estate does not automatically need to become the marketing story.

Buyers care about:

  • The home

  • Condition

  • Location

  • Price

  • Terms

  • Financing

  • Inspection expectations

  • Closing timeline

I focus the public marketing on the property, not private family circumstances.

When the estate or condition creates terms buyers genuinely need to understand — such as an as-is sale or limitations on repairs — those terms should be communicated clearly.

The family's personal story does not need to become advertising.

Probate Real Estate Frequently Asked Questions

Can we sell the home as-is?

Often, yes. Whether that is the best financial strategy depends on the property's condition, likely buyer pool and the estate's priorities.

Do we need to clean out the house before contacting you?

No. I prefer to evaluate the property first so we can decide what work is actually worthwhile.

Can you tell us whether the property has to go through probate?

I can help identify the question, but the legal determination should come from the estate attorney and appropriate title professional.

Who signs the listing agreement and purchase agreement?

The person or people with legal authority to act for the property. I coordinate with title and the estate's attorney to confirm that before relying on assumptions.

Can you provide a date-of-death appraisal?

I provide real estate market analysis for selling purposes. If a formal appraisal is needed for estate, legal or tax purposes, I can help coordinate a licensed appraiser.

What if the home needs extensive repairs?

We can compare selling in its current condition against selective repairs or broader preparation. The goal is to evaluate the likely return, not renovate simply because the home is dated.

Can you help with an estate sale or clean-out?

Yes. I can help connect and coordinate appropriate local professionals when those services are needed.

Can you help if I live outside Minnesota?

Yes. Remote personal representatives are common, and much of the transaction can be coordinated electronically while I help manage the property locally.

Do you provide probate legal advice?

No. I am a real estate professional. Probate law, estate administration, taxes and legal authority belong with the estate's attorney, accountant and other qualified professionals.
